Editorial
A lot of interesting emails have crossed my desk this
week. So I thought I would comment on several of them
and offer suggestions.
One email introduced a new product by Len Thermond and
Bruce Safran. Since Len is a friend and fellow member of
The International Council of Online Professionals (I-Cop)
I felt the product was worth investigating. The product
is called Auto Web Law Pro. It's described at:

It is a product designed to help you make sure your
website is in compliance with all of the laws that you
may not even be aware of - but which your web-based
business must comply with. A number of marketers I am
aware of have gotten in trouble over the past few months
.... allegedly for violating some of these laws.
The Federal Communications Commission (FCC) has jurdistion
over web businesses in the US. They have a division whose
only job is to go around examining websites and making
sure they are complying with the laws. What laws? Well
... there are laws on truth in advertising, unfair
business competiton, price-fixing, and tons of others. If
you violate some of these laws you are guilty by default
... there is no trial, you are just told to pay the fine.
You could be shut down with no warning!
Many people who skirt these laws don't even know it.
For example, if you sell a set of reprint rights and
specify what price the product must be sold at, you are
violating US laws. If you buy a set of reprint rights
and click the "I agree" button on a website before buying
that set of reprint rights, with the fixed suggested
price, you are probably violating price-fixing and
collusion laws.
I looked Len and Bruce's product over and it is a good
product if you cannot afford to hire you own attorney. I
personally have my own attorney who specializes in
internet marketing law as well as business law. He created
several legal documents for several of my sites to ensure
I not only did not violate any laws... but if I am ever
sued, the court case has to be tried in my jurisdiction.

As I said earlier, I think Auto Web Law is a good
product if you cannot afford your own attorney. The
problem is that each location and each situation does
have unique factors that template forms don't address.

On another topic....
My friend Paul Myers also sent an interesting email to his
list this week. It had to do with AOL selling it's customer
email addresses to spammers. AOL executives were asked
specifically about this practice at a recent hearing and

I also got an email from Mark Joyner telling me that
his going out of business sale is 1/2 over. He is selling
2000 copies of his huge package, including his proprietary
software, then he is out of the internet marketing
business. The packages sell for $997 each and he has
already sold 1000. He plans on selling 1000 more but is
going to raise the price to $1495 in few days. If you
were considering getting Mark's package, don't delay.
Frankly, I don't think the package is for everyone. You
get a lot of proprietary source code that's worth a fortune
but not in it's raw form. You still need to have your
programmer integrate it into your system. There are several
restrictions on how you can use products in the package,

Finally, I just wanted to share some advice learned the hard
way this week. On Sunday, May 18th, we had a large thunderstorm
pass through my area. I have all of my electronic equipment
plugged into surge protectors. That wasn't good enough. The
lines my cable company and my telephone company ran into my
home office weren't adequately protected. So I "lost" 2
computers, 3 telephones, a fax machine and 2 televisions. I
also lost a lot due to down-time while computers and other
equipment were worked on to see what could be salvaged.
The lessons I learned from the experience were:
- Your phone lines and cable modems need to be run through
surge protectors with adequate shielding too.
- Your surge protectors are generally only good for one major
lightning strike or electrical surge. So they should be
replaced if you suspect they have already saved you once.
- In my area... we get a lot of thunderstorms.... you should
replace your surge protectors every 3 years.
That's it for this week. I still have a lot of email to answer
since I was offline for several days while they worked on my
computers, phone lines, and cable lines. Some people in my
area are still waiting to get reconnected :-)
